ATSE Legal

Terms of Service

Non-binding English summary of the terms for the software platform ATSE (Automated Trading Strategy Engine). The German AGB are legally binding.

These Terms of Service are a non-binding English summary of our German General Terms and Conditions (AGB). Only the German AGB are legally binding; in case of any discrepancy they prevail. Provider: JG Enterprise Capital GmbH, Bergfeld 18, 21647 Moisburg, Germany, office@jg-enterprise-capital.com.

1. Description of the Service

ATSE is a software platform designed to allow users to:

  • configure automated trading strategies
  • analyze historical market data
  • connect their own brokerage account
  • execute trading strategies via automated scripts

Depending on the plan, the contract covers the downloadable software including updates, online functions (account, licence management, cloud library) and technical support; the Professional plan adds a weekly technical session (AGB sections 2 and 5).

ATSE provides technical tools only. ATSE does not act as a broker, investment advisor, or financial institution. Users execute all trades through their own broker account.

2. User Responsibilities

Users are responsible for:

  • configuring their strategies
  • connecting their brokerage account
  • setting risk parameters
  • monitoring trading activity

The operator of ATSE has no control over user trading decisions. We strongly recommend testing every strategy in backtests and paper trading before using real capital.

Users must ensure that their use of the platform complies with local financial regulations, broker requirements, and applicable laws.

3. No Guarantee of Profit

ATSE does not guarantee any trading performance.

Users acknowledge that:

  • financial markets are unpredictable
  • trading strategies may produce losses
  • past performance does not guarantee future results

Trading decisions and their financial outcome are the user's own responsibility.

4. Account Security

Users must keep their login credentials and licence keys confidential and must not share them. Registration is open to adults only.

Liability for damage caused by unauthorized access is governed by section 6 below.

5. Availability of Service

The online functions are generally available around the clock. Short interruptions may occur due to:

  • server maintenance and security updates (scheduled for low-traffic times where possible)
  • network issues
  • external service or broker interface disruptions

Statutory warranty rights for digital products remain unaffected (AGB section 10).

6. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, for fraudulently concealed defects and under any guarantee we have given.

For slight negligence we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for the contract. Trading losses resulting from market movements, broker execution, or the strategies and parameters chosen by the user are not caused by us unless they result from a breach of duty for which we are liable as described above. Mandatory statutory liability remains unaffected (AGB section 11).

7. Changes to Terms, Prices and Features

Changes to the terms and price increases for running subscriptions take effect only with the user's express consent, offered at least six weeks in advance. Silence does not count as consent.

We change the software beyond what is needed to keep it in conformity only for a valid reason (for example new technical environments, broker interfaces, legal requirements, security or new features) and at no extra cost. If a change impairs a consumer's access or use more than insignificantly, the consumer may terminate the contract free of charge within 30 days (AGB section 14).

8. Term, Cancellation and Withdrawal

Paid plans run for an indefinite period and are billed monthly in advance. Users can cancel at any time with effect from the end of the current billing period; there is no minimum term. Cancellation works without login via the button „Verträge hier kündigen“ (cancel contracts here) in the footer of every page, in the dashboard, or by email (AGB section 9).

Consumers have a statutory right of withdrawal, which can also be exercised via the button „Vertrag widerrufen“ (withdraw from contract); see our withdrawal instructions (German).

We may suspend access after a prior warning if users seriously violate these terms, misuse the platform, or engage in illegal activity, and without warning in case of attacks on our systems.

9. User-generated content and the community library

Where enabled, users may upload their own strategy configurations (technical rule templates) to a cloud library and make them visible privately, by link, or publicly, and may import templates shared by others. Only static configurations are shared — never trading signals, orders, account data, or backtest results. Users post content on their own responsibility and warrant that they hold the necessary rights and that the content violates neither the law nor third-party rights. Unlawful, infringing, misleading (in particular unsubstantiated performance claims) or harmful content is prohibited.

Shared content is not reviewed, curated, or endorsed by ATSE in advance. It is not investment advice, and we give no warranty as to its accuracy, suitability, or lawfulness. As a hosting provider we are under no general obligation to monitor stored content, but we remove or block unlawful content once we become aware of it.

Notice and action. Our designated point of contact for content notices and for requests from authorities is: JG Enterprise Capital GmbH, Content Contact Point, Bergfeld 18, 21647 Moisburg, Germany, office@jg-enterprise-capital.com. Languages of communication are German and English. Content can also be reported from inside the application or through our reporting form, which requires no account. We acknowledge notices, review them promptly, carefully, non-arbitrarily and without sole reliance on automated means, and inform the reporter of the outcome with reasons.

Statement of reasons and appeal. If we block a shared entry, we notify its author, state the reasons for the decision, and point them to the appeal route. A block affects only visibility to others; the author's own copy remains untouched. Authors may appeal within six months of being notified, in the application or by email to the contact point above. Appeals are reviewed under the supervision of a natural person, are not decided by automated means alone, and are answered with reasons; an unfounded block is lifted without undue delay. Recourse to the courts or to an out-of-court dispute settlement body remains unaffected. Every decision is logged with its time, reason, and decision-maker.

In the event of the frequent provision of manifestly illegal content, or the frequent submission of manifestly unfounded notices, we may suspend the relevant activity for a reasonable period after issuing a prior warning.

In case of any discrepancy, the German version of our terms (AGB, section 12) prevails.

10. Governing Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers keep the protection of the mandatory provisions of the country in which they have their habitual residence (AGB section 16).

Summary

ATSE is a technical platform for automated strategy execution. It does not replace user judgment, legal compliance, broker obligations, or risk management.
